1. Acceptance of Terms

By accessing or using the NuvaHealth platform (website, application, or any related services), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the platform. These Terms constitute a legally binding agreement between you and NuvaHealth Technologies Pvt. Ltd.

2. About the Platform

NuvaHealth Technologies Pvt. Ltd. ("NuvaHealth," "we," "us," or "our") operates a technology platform that connects patients with independent, licensed Registered Medical Practitioners (RMPs) for medical weight management consultations.

NuvaHealth is a technology intermediary under Section 79 of the Information Technology Act, 2000. This means:

  • NuvaHealth is NOT a healthcare provider or medical practice.
  • NuvaHealth does NOT employ doctors. All doctors on the platform are independent licensed practitioners.
  • NuvaHealth does NOT prescribe medications or make clinical decisions.
  • NuvaHealth does NOT own or operate any pharmacy.
  • NuvaHealth facilitates the connection between patients and doctors through technology.

3. Eligibility

To use the NuvaHealth platform, you must:

  • Be at least 18 years of age.
  • Be a resident of India.
  • Have a valid phone number and email address.
  • Have the legal capacity to enter into a binding agreement under Indian law.

4. Platform Services

What NuvaHealth does:

  • Connects you with licensed, independent RMPs for weight management consultations
  • Facilitates scheduling and communication between you and your doctor
  • Coordinates prescription fulfilment through licensed pharmacy partners
  • Provides health and wellness educational content

What NuvaHealth does NOT do:

  • Provide medical advice, diagnosis, or treatment
  • Prescribe or recommend any specific medication
  • Guarantee any health outcome or weight loss result
  • Override, influence, or control a doctor's clinical decisions
  • Operate as a pharmacy or dispense medications

5. Doctor-Patient Relationship

When you consult with a doctor through NuvaHealth, the doctor-patient relationship is formed directly between you and the doctor — not between you and NuvaHealth.

  • All doctors on NuvaHealth are independent, licensed Registered Medical Practitioners verified through the platform.
  • Clinical decisions, including whether to prescribe medication, are made solely by your treating doctor in their independent professional judgement.
  • Consultations are conducted in accordance with the Telemedicine Practice Guidelines (TPG) 2020 issued by the Board of Governors of the Medical Council of India.
  • NuvaHealth does not interfere with, direct, or control any aspect of the clinical relationship between you and your doctor.

6. Prescriptions and Medications

  • Any prescription issued through the platform is the independent decision of your treating doctor, based on their clinical assessment.
  • Prescriptions for Schedule H drugs require a video consultation with the doctor, in compliance with TPG 2020.
  • Prescriptions are fulfilled by independent, licensed pharmacy partners. NuvaHealth coordinates delivery but does not dispense medications.
  • NuvaHealth does not guarantee that any particular medication will be prescribed. The prescribing decision rests entirely with the doctor.
  • All medications are dispensed in compliance with the Drugs and Cosmetics Act, 1940 and applicable regulations.

7. User Responsibilities

By using the platform, you agree to:

  • Provide accurate, complete, and truthful information about your identity and health.
  • Not use the platform for medical emergencies. If you are experiencing a medical emergency, call your local emergency number or go to the nearest hospital immediately.
  • Follow your doctor's advice and report any adverse effects promptly to your treating doctor.
  • Keep your account credentials secure and confidential.
  • Not share your account or prescription with any other person.
  • Not use the platform for any unlawful purpose or in violation of these Terms.

8. Intellectual Property

All content on the NuvaHealth platform — including text, graphics, logos, designs, software, and other materials — is the property of NuvaHealth Health Technologies Pvt. Ltd. or its licensors and is protected under Indian intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the platform without our prior written consent.

9. Limitation of Liability

As a technology intermediary under Section 79 of the Information Technology Act, 2000:

  • NuvaHealth is not liable for any medical advice, diagnosis, treatment, or clinical decisions made by doctors on the platform.
  • NuvaHealth is not liable for the quality, safety, or efficacy of medications dispensed by pharmacy partners.
  • NuvaHealth is not responsible for any adverse health outcomes resulting from your consultation or treatment.
  • To the maximum extent permitted by law, NuvaHealth's total liability to you for any claims arising from your use of the platform shall not exceed the total fees paid by you to NuvaHealth in the 12 months preceding the claim.

NuvaHealth does not exclude liability where it cannot be excluded under Indian law.

10. Disclaimer of Medical Advice

The NuvaHealth platform does not provide medical advice. All content on the platform, including blog posts, articles, health information, and educational materials, is for informational and educational purposes only.

Nothing on this platform should be construed as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

11. Payment Terms

  • Consultation fees are displayed before you confirm your booking. There are no hidden charges.
  • Payment is required at the time of booking and is processed through secure payment gateways.
  • Medication costs, if applicable, are separate from consultation fees and are charged by the pharmacy partner at the time of fulfilment.
  • Refund policies for consultations are communicated at the time of booking. Refund eligibility depends on the specific circumstances and is handled on a case-by-case basis.

12. Prohibited Conduct

You agree not to:

  • Provide false or misleading information about your identity or health.
  • Use the platform to obtain prescriptions for purposes other than your own legitimate medical treatment.
  • Attempt to influence a doctor's clinical decision or prescribing behaviour.
  • Engage in any activity that disrupts or interferes with the platform's operation.
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform.
  • Use the platform to harass, abuse, or threaten any doctor, staff member, or other user.
  • Resell, redistribute, or commercially exploit any part of the platform without our consent.

13. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, if:

  • You breach any provision of these Terms.
  • We are required to do so by law or regulatory authority.
  • We reasonably believe your conduct poses a risk to the platform, other users, or healthcare professionals.

You may stop using the platform at any time. Upon termination, your right to use the platform ceases immediately, though certain provisions of these Terms (including liability, indemnification, and dispute resolution) will survive.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

15. Dispute Resolution

In the event of any dispute, you agree to first attempt to resolve it informally by contacting us at contact@nuvahealth.in. We will endeavour to address your concern within 30 days.

If the dispute cannot be resolved informally, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, in Bengaluru, Karnataka, India, and the decision of the arbitrator shall be final and binding.

16. Indemnification

You agree to indemnify, defend, and hold harmless NuvaHealth Technologies Pvt. Ltd., its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the platform, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Changes to These Terms

We reserve the right to update these Terms at any time. When we make significant changes, we will notify you by email or through a prominent notice on our platform. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
